Servers and front-of-house staff may write down or enter your phone number into our point-of-sale system to look up or credit your loyalty account.
Commercial information: records of products ordered, catering inquiries, gift card purchases, and loyalty program activity.
Internet or network activity: browsing history on our Site, pages viewed, referring URLs, interaction with our content, and information collected through cookies and tracking technologies.
Geolocation data: approximate location derived from IP address.
Inferences: preferences and characteristics inferred from the categories above, such as dining preferences for marketing.

You can order from us through delivery and catering platforms linked from or integrated with our Site. The list below is representative and not exhaustive. Advertising and analytics partners
We disclose personal information to third parties for analytics, measurement, retargeting, and cross-context behavioral advertising. The list below is representative and not exhaustive. We may add, change, or replace advertising and analytics partners from time to time. Current and example partners include:
Google, including Google Analytics 4, Google Ads, and Google's advertising network (Google Display Network, YouTube, Search Partners).
Meta (Facebook and Instagram) for paid advertising, retargeting, and custom audience building.
Other social or advertising platforms, examples include TikTok, Pinterest, Yelp Ads, X (Twitter), LinkedIn, programmatic display networks, connected TV/streaming ad platforms, local digital advertising vendors, and any similar platform we may add or use from time to time.
Local listing, review, and reputation platforms when integrated with our Site, examples include Google Business Profile, Yelp, TripAdvisor, OpenTable, Resy, and similar or successor platforms we may use.
Other recipients
Professional advisors, including accountants, auditors, and attorneys.
Government, law enforcement, or other parties when required by law, subpoena, or court order, or to protect our legal rights.
Successor entities in connection with a merger, acquisition, financing, or sale of assets.
9. Payment Information and Phone Orders
Payment information for online orders, online reservations that require a deposit, and other electronic transactions is processed by our payment providers, including SpotOn and any payment processor SpotOn uses. We do not store full credit card numbers through the Site.
Phone orders and reservations
When you call us to place a togo order, make a reservation, or arrange catering, our staff may collect personal information from you verbally, including your name, phone number, order details, special requests, and, for some togo orders, your credit card information for payment.
Credit card information taken over the phone is entered directly into our point-of-sale and payment system (SpotOn) to process the transaction. We do not retain full credit card numbers in writing, in voicemail, in email, or in any other form outside of the secure payment system. Staff are instructed not to record or store card numbers after the order is processed.
If you prefer to provide payment information through a more secure channel, you may place your order online at our Site or pay in person when you pick up your order.
10. "Sale" and "Sharing" of Personal Information Under CPRA
We do not sell personal information for monetary consideration. However, California law defines "sharing" broadly to include the disclosure of personal information to third parties for cross-context behavioral advertising, even when no money changes hands. Our use of advertising cookies, pixels, and audience-matching tools from Google Ads, Meta, and similar platforms, including for retargeting, conversion tracking, and custom audience building, may qualify as "sharing" under CPRA.
California residents have the right to opt out of this sharing. To exercise this right, click the Osano cookie preferences icon on any page of our Site and reject Marketing cookies, or use the Do Not Sell or Share My Personal Information section at the bottom of this policy.
You can also opt out by enabling the Global Privacy Control (GPC) signal in your browser. When we receive a valid GPC signal, we treat it as an opt out of sale or sharing for that browser or device and maintain a preference setting showing that the opt out has been honored where technically feasible.
11. Retention

Loyalty program data: while your account is active, plus 2 years after last activity.

Server logs and security data: up to 12 months.

We will verify your identity before responding to a request involving specific personal information by asking you to confirm details we already have on file, such as your email address and recent order history. We will respond to verifiable requests within 45 days. If we need more time, we will notify you and may extend by an additional 45 days as permitted by law.
Authorized agents: you may designate an authorized agent to submit a request on your behalf. We will require the agent to provide written, signed authorization from you and verify your identity directly.
16. Loyalty Program Financial Incentive Notice
We offer a voluntary loyalty program through SpotOn. Members may receive rewards, discounts, birthday offers, promotional offers, or other benefits. To participate, you may provide personal information such as your name, email address, phone number, order history, and loyalty activity.
How your phone number is used
Your phone number is the primary identifier used to look up your loyalty account. When you dine in, place a togo order by phone, or pick up an order, our staff may ask for your phone number to credit your visit and any rewards or points to your loyalty account. Servers may write your phone number on a ticket or enter it into our point-of-sale system for this purpose. Phone numbers used solely to look up an existing loyalty account are not retained outside of the SpotOn loyalty system.
SpotOn as the loyalty platform
Our loyalty program is operated through SpotOn. When you enroll, you create an account with SpotOn and agree to SpotOn’s terms of service and privacy policy in addition to this policy. SpotOn collects and processes loyalty data on its platform under its own privacy practices. You can review SpotOn’s privacy practices at https://www.spoton.com/legal/.
If you have not enrolled in the loyalty program, providing a phone number at the time of an order or visit will not automatically enroll you. You must affirmatively sign up to become a loyalty member.
Enrolling and withdrawing
The material terms of the program are presented when you sign up. You opt in by enrolling in the loyalty program online, in person, or through our ordering or loyalty platform. You may withdraw at any time by contacting us at info@thephoeniciangarden.com or by using any unsubscribe or account preference tools made available through the program.
Value of the program
We estimate the value of personal information collected through the loyalty program based on the value of discounts, rewards, offers, and other benefits made available to members, as well as the expenses we incur to provide those benefits. The value varies by member depending on purchase activity and reward usage. Withdrawing from the program may result in the loss of unused rewards, but we will not otherwise discriminate against you for exercising your privacy rights.
17. Children's Privacy
Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. We also do not knowingly sell or share the personal information of consumers under 16 without affirmative authorization, meaning opt-in consent from the consumer if 13 to 15, or from a parent or guardian if under 13. If you believe a child has provided us with personal information, contact us and we will delete it.
18. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is fully secure, so we cannot guarantee absolute security. Notify us immediately if you suspect a security issue with your account or information.

Our Site may link to third-party websites and services, including but not limited to SpotOn ordering; social media platforms; delivery and catering partners such as DoorDash, Uber Eats, Grubhub, EZCater, and any others we may use; reservation and waitlist platforms; review sites; payment providers; and similar third parties we may add or change over time. The privacy practices of any linked third party are governed by their own privacy policies, not ours. Review the privacy policies of those services before submitting information.
